Chandrachud and Justice Surya Kant ordered the release of financial assistance to the girl Mubashir Ashraf Bhat, saying that we need to promote the youth of Jammu and Kashmir by educating them. . The court said that considering the appeal of the administration, it would mean that the installment of the student’s loan would not be released. Which was originally approved to study in a college. This can affect the academic career of the student to a great extent. 

Spoiled and without expressing any opinion on the question of law, the bench said. Therefore, the special leave petition is dismissed. Justice Chandrachud said, the student is pursuing MBBS from a college in Bangladesh. Yes, there are mistakes on his part, but we all made mistakes in our younger days. At the same time, Justice Surya Kant told the advocate of the Jammu and Kashmir administration that there is a need to bring Kashmiri youth into the mainstream. We need to promote the youth of Jammu and Kashmir by educating them. You want to deprive the young girl of her academic career. That would not be appropriate.

At the same time, Prasad, standing counsel for the Jammu and Kashmir administration, said that legally this is a breach of trust. The Jammu and Kashmir Women’s Development Corporation had released the first installment of a Rs 30 lakh loan sanctioned for the girl student in 2018 but refused to release the latter amount. Because he had taken admitted to Khwaja Yunus Ali Medical College instead of Community Based Medical College in Bangladesh. Not only this, but the corporation had also demanded a refund of six lakh rupees of the amount of the first installment given earlier, citing violation of the rules. Which was challenged by the student in the Jammu and Kashmir High Court. The student had argued that due to the non-availability of seats in a community-based medical college, she was forced to take admission to another college.
